The Supreme Court ruled on the question whether the owner of the land adjacent to the railway may claim compensation for the costs incurred in the removal of vegetation endangering the safety of rail transport, and at the same time confirmed that the damage to the property arises from its damage, regardless of whether the injured party actually paid the costs of repair. Another decision specifies the conditions for suspending the limitation period for a claim for compensation for non-pecuniary damage to health, if the amount of the claim is not precisely quantified in the lawsuit from the beginning. The selection concludes with the still unresolved question of whether an invitation to conclude an implementation contract that deviates from the content of the contract on a future contract may give rise to an obligation to conclude the contract and, if necessary, lead to a claim for a contractual penalty.<\/p>\n","protected":false},"author":117,"featured_media":5720,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[4],"tags":[673,8],"class_list":["post-10440","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-law","tag-legal-news","tag-dreport-newsletter"],"acf":[],"_links":{"self":[{"href":"https:\/\/www.dreport.cz\/en\/wp-json\/wp\/v2\/posts\/10440","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.dreport.cz\/en\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.dreport.cz\/en\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.dreport.cz\/en\/wp-json\/wp\/v2\/users\/117"}],"replies":[{"embeddable":true,"href":"https:\/\/www.dreport.cz\/en\/wp-json\/wp\/v2\/comments?post=10440"}],"version-history":[{"count":2,"href":"https:\/\/www.dreport.cz\/en\/wp-json\/wp\/v2\/posts\/10440\/revisions"}],"predecessor-version":[{"id":10442,"href":"https:\/\/www.dreport.cz\/en\/wp-json\/wp\/v2\/posts\/10440\/revisions\/10442"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.dreport.cz\/en\/wp-json\/wp\/v2\/media\/5720"}],"wp:attachment":[{"href":"https:\/\/www.dreport.cz\/en\/wp-json\/wp\/v2\/media?parent=10440"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.dreport.cz\/en\/wp-json\/wp\/v2\/categories?post=10440"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.dreport.cz\/en\/wp-json\/wp\/v2\/tags?post=10440"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
