Due to the current situation relating to the COVID-19 pandemic and an increased consumption of personal protective equipment, the European Union has decided to restrict its export. The measures apply to safety goggles and screens, face shields, masks, protective suits and gloves, regardless of whether the products originate from the EU or not. The export of a limited amount of these products can be permitted on the basis of a licence and only in restricted cases, i.e. mainly for humanitarian aid, to supply EU’s operations abroad, to assist the WHO or in other emergency operations.
The exporter will be obligated to request a written or electronic licence from the respective public authorities in the country in which the exporter is established. Member States are obligated to process the application in the period of 5 working days since the provision of all the requisite information. If the protective equipment is located in more than one Member State, the exporter is obligated to state this in the application and the prescribed period for granting the licence may be extended up to 10 working days. In the Czech Republic, the permission is granted by the Licensing Authority of the Ministry of Industry and Trade. Without a submission of such exporting licence, the export is prohibited.
The restriction does not apply to the export to Norway, Iceland, Liechtenstein, Switzerland, Andorra, San Marino, Vatican, the Faroe Islands and to some overseas countries, mainly because of their close link to the European single market.
The restriction on the export of the aforementioned products is introduced for a period of 6 weeks, ie until 26 April 2020.
